Ban the Box and Perverse Consequences, Part I
Ban the Box laws are helpful for reducing discrimination against people with criminal records as a whole, while also working towards ending racial discrimination. Because recent research shows that BtB laws can increase discrimination against Black applicants due to stereotyping Black men as more 'criminal', some scholars argue that BtB laws are actually more harmful than helpful. This law professor, however, posits that getting rid of BtB laws is not the solution. Rather, the solution lies in addressing systemic racism.
